The terms & conditions set out below govern the use of services offered by SVARNA DESIGN related to the use of the www.svarnadesign.com site. Customers are advised to read carefully because it can impact the Customer's rights and obligations under the law.
By registering and / or using the site www.svarnadesign.com, the Customer is deemed to have read, understood, understood and agreed to all contents in the Terms & Conditions. These Terms & Conditions are a form of agreement set forth in a legal agreement between the customer and SVARNA DESIGN. 1. Definition

Svarna operates a web portal service business, www.svarnadesign.com, which is an online search for Design Services and registered furniture items.

Svarna website is www.svarnadesign.com.

Terms & Conditions is an agreement between the Customer and Svarna which contains a set of rules governing the rights, obligations, responsibilities of the Customer and Svarna, as well as procedures for using Svarna service system.

Customer is parties who use Svarna Design’s service, including but not limited to Buyers and other parties who simply visit Svarna Design Site.

Buyer is a registered customer who makes an order request for Design Services and / or Furniture Items. Therefore has to receive a quotation and / or invoice in advance.

Designer is interior designers who have collaborated with and become partners with Svarna Design.

Vendor is Furniture vendors who have collaborated and become Svarna partners who sell their products through Svarna Design social media.

Design services are interior design services provided by designers who have collaborated with Svarna to Customers through Svarna Design’s Site, or any kind of platform Svarna agreed to be in.

Furniture items is objects that are tangible / have physical furniture items that can be delivered / meet the delivery criteria by a furniture items delivery service company.

Goods and / or services are design services and furniture items provided to customers through Svarna Design Team.
2. Furniture Goods Purchase Transactions

Buyers are required to transact through transaction procedures that have been determined by Svarna. The buyer makes a payment using the payment method that has been determined by Svarna Design, through the selected and stated Bank Account under stated name. The funds then will be used according to Svarna Design Production Procedure.

When purchasing Furniture Items, the Buyer agrees that:

The buyer is responsible for reading, understanding, and agreeing to the information / overall description of the goods and / or services (including but not limited to color, quality, function, etc.) before making an offer or commitment to purchase.

Buyer acknowledges that the actual color of the product as seen on Svarna website depends on the Buyer's computer monitor. Svarna has made its best efforts to ensure the colors in the photographs displayed on Svarna Site appear as accurate as possible, but cannot guarantee that the appearance of colors on Svarna Site will be accurate.

The buyer enters into a legally binding contract to purchase goods and / or services when the buyer purchases a goods and / or services.

Furniture Goods purchase transactions are made between the Buyer and Svarna Design.

Svarna has full authority to refuse payment without prior notification.

Payment by the Buyer must be made after the invoice sent . The buyer has to submit the proof of transactions afterwards. The buyer is not entitled to submit a claim or demand for the cancellation of the transaction.There is no refund for down payment.

Buyer agrees not to notify or submit proof of payment and / or payment data to parties other than Svarna. In the event of a loss as a result of notification or delivery of proof of payment and / or payment data by the Buyer to another party, this will become the responsibility of the Buyer.

The Buyer understands and agrees that the Furniture Goods that are purchased will go through production process and will take some times as agreed and discussed with Svarna Design Team. However, delays and problems during production will be discussed when occurred.

The buyer understands and agrees that the purchase of furniture items that still require assembly or are not ready to ship, will first be assembled or prepared by the vendors and Svarna Design Production Team. Furniture Items that have been assembled and ready to ship and must have been received by the Buyer within 6 (six) to 12 (twelve) weeks counting from the date Svarna Design receives the purchase of the Furniture Goods.

Buyer fully understands and agrees that all transactions made between Buyer other than through Svarna Official Account and / or without the knowledge of Svarna (through private facilities / networks, sending messages, arranging special transactions outside Svarna site or other efforts) are is the personal responsibility of the Buyer.

The buyer is required to confirm receipt of the Furniture Goods, after receiving the purchased Furniture Goods shipment. Svarna provides a time limit of 1 (one) day after the shipment with the status of "delivered" in Svarna system, for the Buyer to confirm receipt of the Furniture Goods. If within the time limit there is no confirmation or claim from the Buyer, then the Buyer thus declares that the Furniture Item has been well received by the Buyer and the receipt will automatically be confirmed on Svarna system.

Buyer understands and agrees that any claims submitted after confirmation / confirmation of receipt of Furniture Items are not the responsibility of Svarna. Losses arising after confirmation / confirmation of receipt of furniture items are the responsibility of the Buyer personally.

The Buyer understands and agrees that any problems with the delivery of Furniture Items caused by late payments are the responsibility of the Buyer.

The Buyer understands and agrees that the problem of delays in the payment process and additional costs caused by differences in the bank that the Buyer uses with the official Actor Account bank account is the responsibility of the Buyer personally.

Svarna has the authority to make decisions on unresolved transaction issues due to the absence of a settlement agreement, both between Svarna and Buyer, by looking at the existing evidence. Svarna decision is a final decision that cannot be contested and binds Svarna party and the Buyer to comply.

Buyers are required to make payments with a nominal value that matches the amount of the bill. Svarna is not responsible for the losses suffered by the Buyer if they make a payment that does not match the bill amount stated on the payment page.

Buyer fully understands and agrees that the invoice issued is in the name of Svarna with details that mentioned.
3. Price

Prices for furniture items are subjected to every unique items. Prices may be decided according to design, material, lead times and location of buyer.

Buyer understands and agrees that any problems and / or disputes arising from the disagreement between Svarna and Buyer regarding price are not the responsibility of Svarna.

By placing an order through Svarna, the Buyer agrees to pay the total costs to be paid as stated on the payment term in the invoice / quotation, which consists of the price of the goods, postage, and other costs that may arise. Buyer agrees to make payments via the chosen bank.
4. Types of Furniture Items
Types of furniture items that are highlighted on Svarna site are furniture items such as sofas, armchairs, dining chairs, console cabinet, partitions, and coffee tables.
5. Lead Times
Lead times for NON- In-Stock Items are indicated per item basis in the quotation. Lead times are only counted starting from full down payment received and full order details confirmation by customer on the selected items to order.
6. Payment

Buyers can choose to use the preferred payment method wether to transfer the fund to appointed bank account or using marketplace platform to purchase.

Furniture goods purchase transactions using a credit card must follow the Terms & Conditions set by Svarna and use the courier / logistics provided and connected to Svarna site.

Buyers are prohibited from using a credit card payment method other than its designation as a means of payment.

If the purchase transaction is unsuccessful and / or canceled, the bill for the transaction will be canceled and the transaction funds will be returned to the buyer's credit card limit on the next bill. The provisions in this paragraph do not apply to purchases of furniture items using a credit card that violate legal provisions and / or the Terms & Conditions of Svarna.

Purchase transactions using the credit card payment method will be subject to a service fee that must be paid in accordance with the provisions of each credit card issuing bank used.
7. Furniture Goods Delivery

The delivery of furniture items on Svarna Site is to use the internal service of Svarna Design.

If defects regarding the product occurred during delivery, Svarna Design is entitled to solve the problems and deliver products to client in good condition.

Svarna will notify Buyer if unable to meet the expected delivery date, but, to the extent permitted by law, Svarna will not be liable to Buyer for any losses, liabilities, damage costs, or expenses. others arising from delays.

Please note that at this time Svarna will only deliver furniture items in Jabodetabek (Jakarta, Bogor, Depok, Tangerang, and Bekasi) if the delivery of furniture items outside Jabodetabek will be subject to additional service fees that will be borne by the Buyer.
8. Cancellation By Buyer

Buyers can not cancel or refund Design Services payments. If the design ordered by the Buyer is already in the process of being made then buyer still obligated to pay the outstanding payment.

Reselling, repainting, reconditioning of furnitures after sales & delivery are not the responsibility of Svarna Design.
9. Furniture Returns and Returns Policy

If the Furniture item received by the Buyer is damaged, the Buyer can return the Furniture Item by submitting a request to return the Furniture Item to Svarna within 3 (three) days from the receipt of the Furniture Item. The Furniture Item must be unused, the product tag undamaged, and the Furniture Item must be in the original brand packaging (if applicable).

The buyer must ensure that the furniture item to be returned is in the same condition as when it was received by the buyer and is properly packed. In this case, if the Furniture Item is returned in an unsuitable condition, the Vendor has the right not to accept the Furniture Item return.

If it is necessary to process the return of goods, both Svarna and the Buyer are obliged to take responsibility in returning the goods to the workshop.
10. Furniture Goods Guarantee

The buyer can submit a complaint to Svarna for the Furniture Goods that he purchased, due to a defect or damage due to an error from Svarna Design production.

The guarantee period in the form of Replacement of Items whose complaint is submitted to Svarna, is valid up to 3 (three) days from the date of receipt of the Furniture Goods by the Buyer.

Svarna will only help facilitate Buyer complaints during the period but will not be held responsible for any damage to the Furniture Items purchased after the guarantee period

Svarna design gives 3 ( three) years foam warranty for every purchase of private use furnitures.
11. Refund Policy
No refund is compromised by SVARNA DESIGN after any term of payment has been made.
12. Disclaimer of Warranties and Limitation of Liability
Svarna is a web portal with a customer to business owner Marketplace model, which provides services to customers to be able to place orders and purchase Furniture Goods and Design Services. Thus the transaction that occurs is a transaction between the Buyer and the Designer and / or Vendor in Svarna, so that the Customer understands that the proportional limitation of Svarna is as a web portal service provider.
Svarna always strives to keep its service safe, comfortable and functioning properly, but we cannot guarantee continuous operation or access to our Services will always be flawless. The information and data on the Svarna website may not occur in real time.
The Customer agrees that the Customer makes use of Svarna service at Customer's own risk, and Svarna service is provided to the Customer on an "AS IS" and "AS AVAILABLE" basis.
To the extent permitted by applicable law, Svarna (including but not limited to shareholders, directors, employees, agents and affiliated parties) is not responsible, and the Customer agrees not to hold Svarna responsible, for any damage or loss (including but not limited to loss of money, reputation, gain, or other intangible loss) resulting directly or indirectly from:

Customer's use or inability to use Svarna service.

Pricing, Shipping or other directions available in Svarna service.

Delays or interruptions in Svarna service.

Negligence and losses incurred by each customer.

Quality of Design Services.

Quality of Furniture Items.

Furniture Goods Delivery.

Intellectual Property Rights Violation.

Disputes between Customers.

Defamation of others.

Any misuse of Design Services and Furniture Items that have been purchased by the Customer.

Losses due to unofficial payments to parties other than the Official Account of Svarna, which in any way is in the name of Svarna or negligence in writing accounts and / or other information and / or negligence of the bank

Delivery for repair of furniture items that are officially guaranteed from the vendor. Buyers can bring Furniture Items directly to the nearest service center with a warranty card and purchase invoice.

Viruses or other malicious software (bots, scripts, automation tools other than Power Merchant features, hacking tools) obtained by accessing, or connecting to Svarna service.

Any glitches, bugs, errors or inaccuracies in the Svarna service.

Damage to Customer's hardware from use of any Svarna services.

The content, actions, or inaction of third parties, including related to Products on Svarna site are suspected to be fake.

Enforcement actions taken with respect to the Customer's account.

There were hacking actions carried out by third parties to the Customer's account.

Violation of these Terms & Conditions.
13. Intellectual property rights
The name, graphic, video, logo, page header, button icon, script, and the name of Svarna platform are our trademarks in Indonesia owned by Svarna. Buyers may not use any Trademarks without the prior written permission of Svarna. Svarna does not make any proprietary claims on behalf of third parties (including but not limited to Vendors and Designers), trademarks or service marks that appear on Svarna Platform. Any names, trademarks and service marks of third parties (including but not limited to Vendors and Designers) are the property of their respective owners. Information, advice, data, software and content that can be viewed on, contained in, or can be downloaded from the Svarna Platform ("Content"), including, without limitation, all text, graphics, charts, photos, images, videos, Line art, and icons, are copyright protected by, or licensed to, Svarna or Svarna Content suppliers. Svarna also owns copyright over collective works in the selection, coordination, arrangement, presentation, display and enhancement of Content ("Collective Works"). All software used on or within Svarna Platform (the "Software") is the property of Svarna or the property of Svarna software vendor. Viewing, reading, printing, downloading or using the Content and / or Collective Work does not give the Customer any ownership rights or intellectual property rights to the Content, Collective Work, or Software.
Customer is fully responsible for any damages or losses resulting from Customer's infringement of third party intellectual property rights of Svarna (including but not limited to Vendors and Designers) or anything regarding Trademarks, Content, Collective Works, Software and / or other damages against Svarna or Svarna affiliation as, directly or indirectly, the result of copying, distributing, redistributing, transmitting, publishing or using the same for purposes that are contrary to these Terms & Conditions.
14. Compensation
Customers will release Svarna from compensation claims and maintain Svarna (including but not limited to shareholders, directors, employees, agents and affiliated parties) from any claims or claims, including reasonable legal fees, made by third parties that arise in the event that the Customer violates this Agreement, improper use of Svarna service and / or the Customer's violation of the law or the rights of third parties.
15. Choice of Law
This agreement will be governed by and interpreted in accordance with the laws of the Republic of Indonesia, without regard to conflicts of law rules. The customer agrees that any legal action or dispute that may arise from, relate to, or be in any way related to the site and / or this Agreement will be resolved exclusively within the jurisdiction of the courts of the Republic of Indonesia.
16. Renewal
The Terms & Conditions may be changed and / or updated from time to time by Svarna without prior notice. Svarna advises customers to read carefully and check this Terms & Conditions page from time to time for any changes. By continuing to access and use Svarna service, the Customer is deemed to have agreed to the changes in the Terms & Conditions.
